As a Gwinnett County DUI Attorney, I often need to access criminal history records for my clients and witnesses to build a strong defense. The Georgia Crime Information Center (GCIC) provides these records under specific guidelines, and I’m here to walk you through the process based on the official GCIC instructions.
Criminal Cases: What You Need to Know
For criminal cases like DUIs, the GCIC is authorized to release Georgia criminal history records for defendants or witnesses, per O.C.G.A. §35-3-34(a)(2). However, they do not provide juvenile records—those must be requested from the Juvenile Courts.
- The case style (e.g., State of Georgia vs. John Doe)
- Case number (only active cases qualify)
- Name, date of birth, race, sex, and Social Security Number (if available) for each person
- Court documentation if the defendant is indigent
Civil Cases: Limited Access
In civil actions, you can only access felony convictions without consent. For a full criminal history, you’ll need the individual’s signed consent. Felony conviction data and consent forms are available through local law enforcement. The same request details (case style, number, and personal info) on attorney letterhead apply.
Special Notes for Private Investigators and Couriers
Private investigators cannot directly request records—they need a letter from an attorney authorizing them to act on your behalf. If you’re using a courier to submit or pick up requests, make prior arrangements with the GCIC.
How to Submit and Pay
Each request costs $15 per criminal history record, payable via business check, certified check, or money order to the Georgia Bureau of Investigation (GBI). Personal checks are not accepted. Submit your request to:
CCH/Identification Services
ATTN: Attorney Request
Post Office Box 370808
Decatur, Georgia 30037-0808
Specify how you’d like to receive the results—either via encrypted email (include your email address) or U.S. Mail. Processing takes 5-10 business days.
Important Disclosure Rules
Criminal history information is for the attorney and court use only, as you’re acting as an officer of the court. Sharing it outside this context violates O.C.G.A. §35-3-38.
