What are My Rights After a Georgia DUI Arrest?
Unfortunately, as a Georgia DUI defendant you don’t have a lot of rights. There seem to be some general exceptions to the Constitution for a Georgia DUI arrest.
- You have the right to refuse field evaluations. However, an inference may be drawn from your refusal.
- You have the right to speak to an attorney… when you get to jail.
- You have the right to a phone call… when you get to the jail.
- You have the right to refuse a test of your breath, blood or urine… but you may lose your PRIVILEGE to drive.
- You have the right to an independent test of your breath, blood or urine… but you have to take their test first.
- You have the right to FULL INFORMATION if you submit to the State tests…but the courts like to limit what FULL INFORMATION actually is.
